Schengen Visum

Schengen Visa
for Short Stays
or Business Visas

A Schengen visa allows third-country nationals to stay or transit within the Schengen area for up to 90 days within 180 days. This visa is ideal for short-term stays such as business travel or tourism. Requirements for obtaining a Schengen Visa include:

  • A clear and reasonable purpose for travel
  • Self-financing of travel and subsistence costs
  • Commitment to leave the Schengen area before the visa expires
  • Valid health insurance covering the entire Schengen area with
    a minimum coverage of €30,000

The process from visa application at the embassy to visa issuance usually takes about 45 days.

 

Documents required to
apply for a Schengen visa

Applying for a Schengen visa requires the fulfillment of certain conditions and the submission of various documents. The required documents include:

  • A completed and signed visa application form
  • Passport valid for at least three months beyond the intended date of return with at least two empty pages
  • Recent biometric passport photograph
  • Travel health insurance for all Schengen countries with minimum coverage of €30,000
  • Letter of invitation from the German business partner or organization stating the purpose
    and length of stay
  • Financial documents proving the applicant's ability to cover stay and return expenses
  • Flight and hotel reservations
  • Business documents such as trade register excerpt, business plan, or proof of current business activities

National Visa
Long-term stays

Third-country nationals wishing to stay in the Schengen area for more than three months or to carry out business activities require a National Visa. Similar to the Schengen visa, this must be applied for at the relevant embassy or consulate before entry. The application process can take several months. In addition, an expedited expert procedure is available to expedite this process, but processing times vary, so it is important to consider whether this costly procedure is feasible.

Necessary documents for applying for the
national visa

For long-term stays in Germany, more extensive documentation and additional paperwork
are required for the National Visa application. Requirements vary depending on the purpose
of your stay.

  • Application Form: The national visa application form must be fully completed
    and signed.
  • Passport: A valid passport (as for the Schengen Visa).
  • Photo: A recent biometric passport photograph.
  • Travel insurance: Medical insurance to cover the period until the start of employment.
  • Current information and documents: School or university diplomas and other documents proving skills and experience.
  • Letter of invitation or work contract: Depending on the purpose of the stay, a letter of invitation from a German company, a work contract or documents showing the planned business activities.
  • Special documents: Additional documents depending on the purpose of the stay, e.g. commercial register excerpt for company formation.

Appointment

Many consulates require applicants to make an appointment in advance to submit application materials

Collection of Required Documents

On the date of the appointment, the applicant must visit the embassy or consulate in person to submit the documents and provide biometric data
(fingerprints and photograph).

Payment of Visa Fee

The visa fee must be paid during the application process. The fee varies depending on the type of visa and the nationality of the applicant. In general, the fee for a short-term Schengen visa is 80 Euros.

Processing of the application

The processing time for a Schengen visa is usually 15 days. However, if additional documents are requested or a more detailed investigation is required, the processing time may increase to 30 to 60 days.

Decision and Passport Collection

After processing, the applicant will be notified of the decision. If approved, the visa will be affixed to the passport. The applicant may pick up the passport in person or have it mailed to them.

Denial and Appeal

If the application is denied, the applicant will receive a written notice stating the reasons for the denial. The applicant has the right to appeal or reapply within a specified period.

Self-Employment Visa for Entrepreneurs and Investors Section 21
of the Residence Act
(§ 21 AufenthG)

Germany offers the Self-Employment Visa Section 21 of the Residence Act (§ 21 AufenthG) to facilitate the entry and residence of third-country nationals who are entrepreneurs, self-employed persons and investors in Germany. This visa distinguishes between entrepreneurs and self-employed persons, and the conditions for granting the visa vary.

Entrepreneurs engaged in trade Section 21(1) of the Residence Act
(§ 21 (1) AufenthG)

This visa is for third-country nationals who wish to start a new business or take over an existing business in Germany. The following requirements must be:

  • Economic interest and regional need: The business plan must meet an economic interest or a regional need. It should have a positive effect on the German economy, create new jobs, or introduce new technologies.
  • Financing: The applicant must demonstrate that he or she has sufficient financial resources to implement the business plan and maintain his or her livelihood in Germany. This can be done through proof of equity or financial commitments from banks or investors.
  • Valid Business Plan: A detailed business plan must demonstrate the feasibility and profitability of the business. The plan should include market analysis, competitive strategies, and financial projections.
  • Required Qualifications: The applicant must have the necessary professional qualifications and experience to successfully operate the proposed business.
 

Self-employed -Section 21(5) of the Residence Act
(§ 21 (5) AufenthG)

This visa is for self-employed persons who wish to pursue a freelance profession. The following requirements must be met:

  • Proof of an existing source of funding.
  • Permission to practice the profession (if required).
  • Retirement insurance for self-employed persons over 45.

The process from application to visa issuance can take several months. Successful self-employed persons can extend the duration of their visa.

Self-Employment Visa Application Process

  • Visa Application: The applicant submits a visa application to a German diplomatic mission in Turkey and provides all necessary documents (passport, business plan, financing documents, pension insurance).
  • Verification by the German Foreigners Authority: These documents are sent to the Foreigner's Office and relevant authorities in Germany for evaluation.
  • Decision and extension: After entering Germany, the applicant applies for a residence permit at the Foreigners Office. After reviewing the submitted documents and accepting the place of residence, the residence permit is issued. If the business plan is successful, the residence permit can be extended.

Family Reunification

The special status of the family is constitutionally protected in Germany, and this protection extends to immigrants. Third-country nationals with a residence permit, sufficient income, and adequate living space may apply for family reunification. The right to family reunification applies only to the core family, including spouses and minor children. Residence permits for other relatives are granted only in exceptional cases. Spouses must prove basic knowledge of the German language before entry unless an exceptional situation applies.
